1. Acceptance of Terms

By accessing or using DockLead's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Service

DockLead provides an automated missed call follow-up service. When a call to your business goes unanswered, our system sends an SMS to the caller, qualifies them through an AI-powered conversation, and delivers the lead information to you.

3. Account Registration

To use our service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old
  • Have the authority to bind your business to these terms

4. Subscription and Payment

4.1 Pricing

Our service is billed at $299 per month per location. Prices are subject to change with 30 days notice.

4.2 Billing

  • Subscriptions are billed monthly in advance
  • Payment is processed through Stripe
  • You authorize us to charge your payment method on file

4.3 Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months

5. Acceptable Use

You agree NOT to use our service to:

  • Send spam or unsolicited messages
  • Violate any laws, including TCPA, CTIA guidelines, or CAN-SPAM
  • Harass, abuse, or harm others
  • Transmit malicious code or interfere with our systems
  • Impersonate any person or entity
  • Collect information about others without consent

6. Compliance Requirements

6.1 TCPA Compliance

Our service is designed for responding to customer-initiated contact (missed calls). You are responsible for ensuring your use of the service complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA).

6.2 Opt-Out Handling

Our system automatically processes STOP requests and maintains Do Not Contact lists. You agree not to circumvent these protections.

7. Phone Number Provisioning

  • We provision a dedicated phone number for your account
  • This number is for use with our service only
  • Numbers are not portable and cannot be transferred
  • Upon cancellation, your number will be released

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We are not liable for any downtime, delays, or failures in service delivery.

9. Intellectual Property

All content, features, and functionality of our service are owned by DockLead and are protected by copyright, trademark, and other intellectual property laws.

10. Data and Privacy

Your use of the service is also governed by our Privacy Policy. You retain ownership of your customer data. We may use aggregated, anonymized data to improve our services.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCKLEAD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless DockLead, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

13. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of material changes.

14. Termination

We may terminate or suspend your account immediately for violations of these terms. Upon termination:

  • Your access to the service will cease
  • Your phone number will be released
  • You may request export of your data within 30 days

15. Dispute Resolution

Any disputes arising from these terms or the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Florida.

16. Governing Law

These terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions.

17. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These terms, together with the Privacy Policy, constitute the entire agreement between you and DockLead regarding the service.
